Labour & health-and-safety law

  • Arbejdsmiljøloven (LBK 2062/2021) — General act requiring employers to plan work so it is fully safe and healthy; enforced by Arbejdstilsynet.
  • BFA-BA roof-work guidance — Requires roof-edge protection always above 3.5 m; a written assessment between 2 and 3.5 m; below 2 m only where a special hazard such as strong wind exists.
  • Arbejdstilsynet — Sikkerhed ved tagarbejde — Safety lines cannot replace collective protection (a guardrail) where the work lasts more than approximately 4 hours.
  • Directive 89/391/EEC Art 6(2)(h) & 2001/45/EC Annex — EU basis: collective protective measures take priority over individual protective measures; transposed into Danish law.
  • Bekendtgørelse on client/designer duties (to verify) — Places design-stage duties to design out fall risk on the client and designer; exact article numbers not yet established.

Building, product & standards framework

  • EN/DS 13374 — Minimum standard referenced by Danish roof guidance for guardrail geometry (class A/B/C), though it is a temporary-railing standard.
  • DS/EN 1991-1-4 (DK NA) — Danish national annex to the wind Eurocode, used for per-project wind declarations because EN 13374 is rated below Danish design wind.
  • CE/CPR — BEK 1465/2021 — Requires correct CE marking and a declaration of performance for construction products; market surveillance by Sikkerhedsstyrelsen.
  • Markedsføringsloven (LBK 1420/2024) §§5-6 — Prohibits misleading marketing claims, reaching both B2B and B2C; enforced by Forbrugerombudsmanden, which can seek injunctions and damages.

Legal justification

“Efter arbejdsmiljøloven og BFA-BA's vejledning om arbejde på tage går kollektive sikkerhedsforanstaltninger forud for individuel beskyttelse; sikkerhedsliner kan ikke erstatte et rækværk, når arbejdet varer mere end ca. 4 timer. For tage med regelmæssig adgang, som ved drift af solcelleanlæg, er et permanent rækværk derfor den rette løsning frem for gentagen udlejning af midlertidig afspærring. Økonomiske hensyn kan ikke begrunde at fravige denne prioritering.”

English translation: Under the Arbejdsmiljøloven and BFA-BA's roof-work guidance, collective safety measures take priority over individual protection; safety lines cannot replace a guardrail where work lasts more than approximately 4 hours. For roofs with recurring access, such as solar O&M, permanent guardrail is therefore the preferred choice over repeated hire of temporary barriers. Economic considerations do not justify deviating from this priority.
